Nebraska eviction hearings have been delayed until May 31, 2020, in cases where the renter qualifies for the delay. Nebraska Governor Pete Ricketts has temporarily delayed evictions in certain situations because of COVID-19 and the economic challenges people are facing.
In order to delay the eviction, the renter has to prove, in court:
- A substantial loss of income because of COVID-19. This includes reduction in work hours and closures of work places; OR
- That the renter missed work to care for a relative or a child because childcare or schools have been closed.
Additionally, landlords cannot evict a tenant who has a suspected or confirmed diagnosis of COVID-19.
This delay of eviction trials does not eliminate the tenant’s responsibility to pay rent. The rent for March, April, and May 2020 will still be owed, and evictions will probably resume in June.
